REQUIREMENTS

  • Having been officially accepted in any officially recognised public or private Spanish teaching or scientific centre for research work.
  • Criminal records clearance in Spain and in other countries of residence in the five years before the application.
  • Not being in an illegal situation in Spain.

 

PROCESS

1. APPLICATION FOR A RESEARCH VISA

WHERE: The Spanish consulate in the applicant’s country of residence. Select the Spanish representative office of your place of residence.

WHO: The researcher.

DOCUMENTATION (translated into Spanish):

  • Application for a national visa. Click here to download the form.
  • Passport with a minimum validity of four months and a copy of all the pages.
  • Criminal records clearance in the countries of residence in the five years before the application (only if the research project will last more than six months).
  • Updated medical certificate (only if the research project will last more than six months).
  • Two photographs.
  • Medical insurance covering medical expenses and repatriation associated with an accident or an unexpected illness during his or her stay in Spain.
  • Documents certifying that the applicant has sufficient funds for accommodation and expenses in Spain during the period for which the visa is being applied for.
  • Admission to an officially recognised public or private educational establishment for research work.
  • Content of the research project.
  • Fees.


 

2. VISA COLLECTION

ISSUE PERIOD

Researchers hired by research organizations authorised to sign hosting agreements

For foreign researchers staying in Spain exclusively and mainly for research projects under a hosting agreement signed with a public or private research organisation authorised to sign hosting agreements.

REQUIREMENTS

FOR SIGNING THE HOSTING AGREEMENT:

a) The research project must have been accepted by the relevant bodies of the organisation, and its purpose and duration must be appropriately specified. There must also be sufficient material and financial resources for the project.

b) The foreign researcher must provide evidence that he or she holds a higher qualification for accessing the doctorate programmes, relating to the research project for which the temporary work and residence permit is being applied for.

PROCESS

1. APPLICATION FOR A TEMPORARY RESIDENCE AND WORK PERMIT FOR RESEARCH

WHO: The research organisation through its legal representative.

WHERE: Oficina de Extranjería (Provincial Immigration Office). Select the office that corresponds to your address.

DOCUMENTATION: (translated into Spanish):

  • Three copies of application Form EX04, signed and submitted in person by the employer or the legal representative of the Spanish company.
  • Public document granting powers of attorney to the individual making the application, filed with the commercial registry or the corresponding registry.
  • Public document certifying the capacity to hire the individual signing the contract.
  • Identity document of the person signing the application.
  • Tax identification number (NIF).
  • Certificate issued by the State Secretary of Research, and Innovation and Development, stating that the research organisation is authorised to sign hosting agreements.
  • Hosting agreement signed by the foreign researcher and the research organisation, comprising a memorandum describing the research project and the employment contract between the two parties.
  • Certificate stating that the company is up to date with its social security obligations. The authorities must acquire this ex officio. N.B.: although the authorities can acquire this ex officio, submitting the certificate speeds up the process.
  • Certificate issued by the tax authorities stating that the company is up to date with its tax obligations. The authorities must acquire this ex officio. N.B.: although the authorities can acquire this ex officio, submitting the certificate speeds up the process.
  • Copy of all the pages of the worker's passport. Sometimes, a copy of the authentication issued by the Spanish consulate in the country of residence can be required.
  • Certification of the qualifications required for the job.

2. APPLICATION FOR A RESIDENCE AND WORK PERMIT FOR RESEARCH

Researchers hired by private companies via ordinary channels

REQUIREMENTS

  • The national employment situation must allow for the foreign worker to be hired, or proof of the worker being in one of the circumstances described in article 40 of Act 4/2000 of January 11, as indicated below, must be provided, in which case no consideration will be given to the national employment situation.
  • The worker must be guaranteed continued activity during the term of validity of the work and residence permit.
  • The applicant companies must be registered with the relevant social security system and up to date with their tax and social security obligations. Under the terms provided, the employer can also be required to provide evidence of the financial, material and personal resources available for the business project.
  • The terms and conditions established in the job offer must correspond to those in current legislation for the same activity, occupational category and location.
  • Qualification or evidence of the training required for practising the profession, where applicable, validated.
  • Criminal records clearance in Spain and in other countries of residence in the five years before the application.
  • The foreign worker is not in an illegal situation in Spain.

  • Three copies of application Form EX04, signed and submitted in person by the employer or the legal representative of the Spanish company.
  • Public document granting powers of attorney to the individual making the application, filed with the commercial registry or the corresponding registry.
  • Document certifying an employment relationship with the applicant company in case a general or specific power of attorney has been granted.
  • Identity document of the person signing the application.
  • Tax identification number (NIF).
  • Employment contract signed by authorised individuals.
  • Public document certifying the capacity for hiring the individual signing the contract.
  • Alternatively:
    • Certificate issued by the national employment service showing the result of the job offer presented, together with a copy stamped by the employment office if the job offered is not included in the catalogue of occupations that are not easily covered (“CODC”).
    • Documentation proving that he or she is in one of the circumstances described in article 40 of Organic Act 4/2000 of January 11, in which case the national employment situation will not be considered.
  • Certificate stating that the company is up to date with its social security obligations. The authorities must acquire this ex officio. N.B.: although the authorities can acquire this ex officio, submitting the certificate speeds up the process.

  • Certification of the qualifications required for the job.

Researchers hired by private companies via the UGE-CE (Unit for Large Companies and Strategic Economic Sectors)

REQUIREMENTS

  • Highly qualified technicians and scientists hired for research work or for development activities at private universities or research and development departments at businesses set up in Spain and registered as such with the State Secretary for Research, Development and Innovation. Click on the following link to the State Secretary to find out how to register as a research & development centre, as well to access the application form: Secretary of State for RID.
  • The worker must be guaranteed continued activity during the term of validity of the temporary work and residence permit.
  • The applicant companies must be registered with the relevant social security system and up to date with their tax and social security obligations. Under the terms provided, the employer can also be required to provide evidence of the financial, material and personal resources available for the business project.
  • The terms and conditions established in the job offer must correspond to those in current legislation for the same activity, occupational category and location.
  • Qualification or evidence of the training required for practising the profession, where applicable, validated.
  • Criminal records clearance in Spain and in other countries of residence in the five years before the application.
  • The foreign workers are not in an illegal situation in Spain.
  • Evidence must be provided of one year of experience in scientific research or technological development jobs or projects and activities similar to the one to be carried out.

  • Public document granting powers of attorney to the individual making the application, filed with the commercial registry or the corresponding registry.
  • Document certifying the professional relationship in case a general or special power of attorney has been granted.
  • Identity document of the person signing the application.
  • Public document certifying the capacity to hire the individual signing the contract.
  • Identity document of the person signing the contract. Tax identification number of the company or organisation.
  • Memorandum describing the company's activity.
  • Favourable report issued by the State Secretary for Research, and Development and Innovation or relevant office of the autonomous region. Hosting agreement signed by the foreign researcher and the research organisation, comprising the memorandum describing the research project and the employment contract signed by the two parties, together with evidence of the availability of the financial and material resources required for the project.
  • Profile of the job being offered.
  • Certificate or affidavit stating that, in the 12 months immediately before the application date, the company did not write off the jobs it wishes to cover through unfair or null and void dismissal or as a result of collective redundancies.
  • Copy of all the pages of a valid passport or travel document, with a minimum validity of four months.
  • Copy of the national identity document or other official documentation showing the identity number.
  • Researcher's CV.
  • Evidence of the required qualifications and, where applicable, validated qualifications and, if required by law, membership of the corresponding professional association or charter.
  • Documentation proving that the worker has carried out the same activity or has held a post similar to the one to be covered for at least one year.
  • Fees.
