Workers of foreign cultural institutions hired for a programme in Spain

REQUIREMENTS

Executive staff or foreign teachers from (i) cultural institutions or educational establishments that depend on other countries, or (ii) private institutions, of proven reputation, officially recognised by Spain, carrying out cultural and educational programmes in Spain relating to their countries providing they limit their activities to the implementation of such programmes.

Exceptions can apply to foreigners in the following circumstances:

  • Those who hold management positions, or are teachers or researchers, and limit their occupation to the mentioned activity at foreign cultural or educational institutions based in Spain.
  • In the case of cultural or educational institutions that depend on other countries, the foreigners must carry out their activities in Spain in such a way that the courses studied, programmes developed and the qualifications or diplomas issued are valid and recognised by the countries on which they depend.
  • In the case of foreign private institutions, their reputation will be considered proven when the institution and the activities are carried out have been officially recognised and authorised by the relevant authorities, and the qualifications or diplomas they issue are valid and recognised by the countries on which they depend.

1. APPLICATION FOR RESIDENCE VISA EXCLUDING A WORK PERMIT

Who: Worker.

  • Updated criminal records certificate issued by the relevant authorities of the countries in which the interested party has resided in the five years before submission of the application.

  • Employment contract or appointment for the management or teaching activities and, in the case of private institutions, documentation providing evidence of official recognition in Spain.

2. VISA COLLECTION

3. APPLICATION FOR RESIDENCE PERMIT EXCLUDING A WORK PERMIT

Where: Oficina de Extranjería (Provincial Immigration Office). Select the office nearest to your address.

  • Passport.

4. APPLICATION FOR RESIDENCE CARD FOR FOREIGNERS (only if the residence is for more than six months)

Where: Police station. Select the police station nearest to your address.

Civil servants or soldiers working in Spain

REQUIREMENTS

Civil servants or soldiers from foreign state administrations who come to Spain to carry out activities under cooperation agreements with the Spanish administration.

PROCESS

This status will apply to foreigners who are part of the representation, governing and administration bodies of internationally recognised trade unions and business organisations, as long as their activities are limited strictly to the functions inherent to that status.

Members of religious orders

REQUIREMENTS

Religious ministers and members of the hierarchy of churches, religions and religious communities, as well as members of religious orders.

This status will apply to individuals who meet the following requirements:

  • They are members of a religion, church, religious community or religious order filed with the Register of Religious Organisations of the Ministry of Justice.
  • They are religious ministers, members of the hierarchy or religious orders, given that they comply with the requirements in their statutory regulations.
  • The activities they are to carry out in Spain are strictly religious or, in the case of members of religious orders, they are merely contemplative or correspond to the statutory purposes of the order. Remunerated activities not carried out within these bounds are excluded.
  • The entity on which they depend assumes their upkeep expenses.

Artists who come to Spain for specific performances that do not involve continued activity

REQUIREMENTS

Foreigners who, individually or collectively, travel to Spain for an artistic activity, performed directly to an audience or for any type of recording for broadcast, on any media or at any premises normally or occasionally used for public artistic shows or performances.

The activities they carry out cannot exceed five consecutive days or 20 days in a period of less than six months.

REQUIREMENTS

Artists of international renown, as well as the staff required for their performance, whose activity exceeds five consecutive days or 20 days in a period of less than six months.

PROCESS

1. APPLICATION FOR INITIAL TEMPORARY RESIDENCE PERMIT AND WORK PERMIT AS AN EMPLOYED WORKER FOR INTERNATIONALLY RENOWNED ARTISTS AND THE STAFF REQUIRED FOR THEIR PERFORMANCE

Where: Unit for Large Companies and Strategic Economic Sectors UGE-CE. NB: Check whether you qualify for the UGE-CE by going to the Unit for Large Companies and Strategic Economic Sectors section.

Who: the artist.

Documentation (translated into Spanish):

  • Three copies of application Form EX03 , signed and presented in person by the employer or the legal representative.
  • Public document granting powers of attorney to the individual making the application, filed with the corresponding registry.
  • Document certifying the employment relationship in case a general or special power of attorney has been granted.
  • Identity document of the person signing the application.
  • Employment contract signed by the authorised individuals, linking the artist or the company to which he or she belongs with the permit applicant. The job that is offered must correspond to the national catalogue of occupations (Spanish acronym: “CNO”).
  • Public document of the company showing the capacity to hire the signatory or the power for entering into a contract executed for the signatory of the contract.
  • Identity document of the person signing the contract.
  • Copy of the tax identification number of the applicant company.
  • Evidence that it has the financial, material and human resources required for its business project and for fulfilling the obligations derived from the contract.
  • Memorandum explaining the performance, indicating the number of shows and their dates, venues and capacity, together with details of the individuals in the team and other relevant details.
  • Copy of the passport or travel document, with a minimum validity of four months.
  • Copy of the national identity document or other official documentation bearing the identity number.
  • CV of the artist or the company to which he or she belongs.
  • Document providing evidence of the employment relationship between the artist and the company to which he or she belongs.
  • Documentation providing evidence of the artist's participation in an international project of cultural or social significance if the artist takes part in such a project.
